Definitions:
"Platform" refers to the CoLab mobile application and website.
"User" refers to anyone accessing CoLab, including individuals, startups, and creatives.
"Project" refers to any task, collaboration, or assignment posted and managed within CoLab.
"Payment Processing" refers to future planned features that will allow users to transact securely within the platform.
Eligibility & User Accounts
Users must be at least 18 years old to create an account.
Users agree to provide accurate and complete registration information.
Users are responsible for safeguarding their account credentials.
CoLab reserves the right to suspend or terminate accounts that violate these Terms.
Services Provided
CoLab enables:
Project collaboration between startups and creatives.
Networking and team-building within creative industries.
Resource sharing for project execution.
CoLab does not currently provide payment processing or escrow services. Users are responsible for managing payments externally.
Payments & Fees
We intend to integrate a secure payment processing system to facilitate transactions. Until this feature is launched, all payments between users must be handled outside of CoLab.
User Conduct & Restrictions
Users agree not to:
Engage in fraudulent or misleading activities.
Use CoLab for illegal or unethical purposes.
Upload harmful content, including spam, malware, or copyrighted material without permission.
Harass, threaten, or abuse other users.
Intellectual Property Rights
Users retain ownership of content they create and upload.
By submitting content, users grant CoLab a non-exclusive, royalty-free license to display and promote their work within the platform.
The CoLab logo, trademarks, and platform features remain the exclusive property of CoLab.
Privacy & Data Protection
CoLab respects user privacy and complies with GDPR and applicable data protection laws. Our Privacy Policy explains how we collect, store, and use user data. Users should review it separately.
Limitation of Liability
CoLab is not responsible for disputes, losses, or damages resulting from user interactions.
Users engage in projects and transactions at their own risk.
We do not guarantee uninterrupted or error-free service.
Dispute Resolution
Disputes between users must be resolved independently. CoLab is not liable for disagreements over project execution or payment. Future dispute resolution mechanisms will be introduced alongside our planned payment system.
Termination & Account Suspension:
CoLab reserves the right to suspend or terminate accounts that:
Violate these Terms.
Engage in fraudulent activities.
Pose a security risk to the platform or other users.
Users may delete their accounts at any time by contacting info@thecolab.co.za
Changes to Terms & Conditions
CoLab may update these Terms periodically. Users will be notified of major changes and continued use of the platform implies acceptance of updated Terms.
Governing Law
These Terms are governed by the laws of South Africa. CoLab operates under the following legal frameworks:
Electronic Communications and Transactions Act (ECTA): Ensures the validity of electronic contracts and mandates clear consent from users.
Consumer Protection Act (CPA): Protects users by requiring transparent, fair, and reasonable terms.
Protection of Personal Information Act (POPIA): Regulates the collection, processing, and storage of personal data. Our Privacy Policy outlines compliance measures.
Users agree to submit to the jurisdiction of the courts in South Africa for any disputes arising from these Terms.
